Terms of Service

These terms govern your use of the Kaizen AI Solutions website and the Kaizen AI receptionist service (“the Service”), plus the website builds described in section 9. By using the website or purchasing the Service, you agree to them. If you're signing up on behalf of a business, you're agreeing for that business.

1. The Service

Kaizen AI provides a managed AI receptionist: we build, train, connect and tune an AI voice agent that answers calls for your business, books appointments, captures leads, and transfers calls to humans according to rules you approve. It is a done-for-you service. We operate the agent, and you approve how it behaves before it goes live.

2. Call recording, transcription & consent

Calls handled by the Service are recorded and transcribed so we can deliver transcripts, lead details, and quality tuning. You are responsible for complying with the call-recording and monitoring laws that apply to your business and your callers, including two-party-consent states such as California, and for any disclosures those laws require. On request, we will configure your agent to announce that calls are recorded. Do not use the Service where recording is prohibited.

3. Plans, minutes & billing

Published plans are billed as a flat monthly subscription with no setup fee and a block of included talk-minutes (time the agent spends on live calls; screened spam and robocalls don't count). We alert you at 80% of your included minutes. Usage beyond your block is billed at your plan's published per-minute overage rate, itemized on your invoice. We never disconnect a live call to save minutes. Billing runs through Stripe; subscriptions are month-to-month and renew automatically until cancelled.

4. Guarantees

72-hour go-live guarantee. If your agent isn't live within 72 hours of the later of (a) your completed discovery call and (b) our receipt of the business information we request, your first monthly subscription fee is free (credited or refunded) and any setup fee is waived. Delays caused on your side (carrier number-porting timelines, pending sign-off, or missing information) pause the clock.

30-day money-back guarantee. If within 30 days of go-live the Service isn't answering your phones the way you want tell us and we refund your first monthly subscription fee. Usage overage is non-refundable. One guarantee claim per business.

5. Your responsibilities

You agree to provide accurate business information and to use the Service only for lawful purposes. The Service answers inbound calls only. It does not place calls or send texts on your behalf. The Service is not an emergency service. It must not be relied on for 911 or life-safety call handling.

6. Your data

Your transcripts, recordings, leads, knowledge base, and phone number are yours. You can export them at any time, including on cancellation, and you can port your number to any carrier. We never sell your call data and never use it to train public AI models. See our Privacy Policy for details.

7. Service quality & disclaimers

We work to keep the Service running and tune it monthly, but no phone system, human or AI, is perfect. The Service is provided “as is”; we don't guarantee uninterrupted operation, and AI agents can occasionally mishear or misroute a call. To the maximum extent permitted by law, our total liability for any claim related to the Service is limited to the fees you paid us in the three months before the claim arose, and we are not liable for indirect damages such as lost business or lost profits.

8. Cancellation

Cancel any time by emailing hello@kaizenaisolutions.com. Cancellation takes effect at the end of the current billing period. On cancellation we export your data and release your number for porting.

9. Websites

A website build is priced in a written quote you approve, paid before work starts. You approve the site before it goes live. After launch the plan starts at $39 a month or $300 a year; the price for your site is in your written quote. It covers hosting, changes and management of your Google business profile. You can cancel the monthly plan any time. The yearly plan can be cancelled at renewal.

Included changes are updates to your prices, hours, menu, photos and text, whenever you need them. New pages, a redesign, online ordering or booking systems, and new features are not included. We quote them separately and tell you the price before doing any of that work.

You own your domain and your content. If you leave, we hand everything over. The 72-hour go-live guarantee in section 4 applies to the receptionist only, not to websites.

10. Changes & governing law

We may update these terms; material changes will be posted here with a new “last updated” date, and continued use after that constitutes acceptance. These terms are governed by the laws of the State of California.
